the matter; and there is reason for believing that proceed- ings would never have been taken, had it not been for the insistence of certain lawyers who advised that succese was certain. The Government's most important witness is Mr. A. G. M. Fletcher, Acting Colonial Secretary, who was Chairman of the Shipping Control Committee; and, as he is shortly proceeding to England on leave, it has been agreed that the case shall not in any event come on for hearing until his return.

I have not thought it worth while at the present stage to have a case stated fully for the considera- tion of the Law Officers of the Crown, but I suggest that their advice should be asked as to the further steps which should be taken. Mr. Fletcher, while he is in England, will be able to supply any information as to facts that may be required.
